As part of our business activities, we collect and process personal data related to you, particularly in instances when you access this website, contact us by telephone, E-mail, fax, post or via the online portal on our website and when you enter into contracts with us as a customer. Personal data, manner and purposes for processing

On our website, we offer to send you information concerning investment options tailored to your personal needs. In order to receive this, you must complete the ‘Investment request’ form. For this purpose, we also ask you to provide us with your contact details (E-mail or telephone) so that we can send you the information. The legal basis for the processing is your consent.

Should you conclude a contract with us as a private customer, we collect and process personal data required for the initiation, execution and termination of the contract and in connection therewith, particularly the following categories:

  • Contact details: Address, E-mail address, telephone number, fax
  • Information relating to your investment, particular on the properties (type, usage, location, condition) and the budget for the investment
  • Financial information: Proof of income, taxation documents (declaration, ID, assessment), Schufa information (credit investigation)

  • Information concerning previous investments and your existing assets

If you conclude a contract with us as a company, we collect and process the personal data of your employees that you communicate to us, in particular the following categories of personal data on the contact persons named by you for our purposes:

  • Surname and first name
  • Position in the company and
  • Business contact details: address, E-mail address, telephone number, fax

We collect the information and personal data you provide in order to process your request when you send us messages via the contact form or the investment request on our website, particularly the following categories:

We collect and store the personal data which is transmitted to us by your internet browser. These data are elusively used for the purpose of enabling your visit to our website and for improving the functionality of the website. Should the provision of your personal data be necessary for processing your inquiry or for fulfilling the contract with you, the lack of provision may result – depending on the type of data – in our inability to process your inquiry or your contract. We use your personal data from the submission of a contact form on our website exclusively for processing your request. Within the framework of the contracts, we process your personal data for the real estate investment solutions we offer.

We do not process any special categories of your personal data (sensitive data). The BATO offer is only intended for those over the age of 18.

Data of applicants

Should you apply for a job position with us, we process the personal data you provide us with in your application. We use this data exclusively for the selection procedure for the position which you have applied. If you have provided us with your consent, we will subsequently also consider your application for other suitable vacancies at BATO or at another company belonging to the group. In such a case, your personal data from the application will also be used for the alternative selection procedure and, should this concern a position in another company within our company group, be transmitted to this company. Should your application be successful, your application documents will become part of your personnel file. Otherwise, your personal data will be automatically deleted following the conclusion of the selection procedure, or, if you have agreed to the further use of your application, after a period of two years providing no further processing is required for other purposes and is legally permissible.

Please note that your application may also contain special categories of personal data (e.g. information relating to marital status and health) and that your photo may allow conclusions concerning your race or ethnic origin and/or religion to be drawn.

Newsletter data

If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. Further data is not collected or only on a voluntary basis. We use this data exclusively for sending the requested information and do not pass it on to third parties.

The processing of the data entered in the newsletter registration form is based on your consent (Art. 6 para. 1 lit. a DSGVO). Data recipients

We do not sell or transfer your data to third parties without your consent; unless this is necessary for the fulfilment of the contract or we are obliged to do so for legal reasons, e.g. in official or judicial proceedings. In particular, the categories of recipients include estate agents, credit institutions, insurance providers, collection service providers, lawyers, real estate owners, hereditary building beneficiaries, tenants of real estate, property managers as well as selected specialist companies and craftsmen.

When we use contract processors, e.g. as mailing service providers, IT service providers or website administrators, and forward personal data to them, we carefully select them, agree on data protection with them in order processing agreements, instruct and monitor them within the framework of the applicable regulations. BATO as a contract processor

BATO acts as a contract processor for owners or landlords within the framework of property management. BATO processes the personal data of clients in compliance with the instructions of the clients within the framework of order processing. Information on order processing, particularly personal data and the processing thereof, is provided by the clients as the responsible parties.

Legal basis/legitimate interests

The collection and processing of your personal data is permitted

  • pursuant to Art. 6 para. 1 sentence 1 (a) GDPR insofar as we have obtained your consent for specific purposes (particularly for the sending of newsletters and marketing information)
  • pursuant to Art. para. 1 sentence 1 (b) GDPR insofar as processing is necessary for the fulfilment of a contract with you or for the implementation of pre-contractual measures which are undertaken at your request
  • pursuant to Art. 6 para. 1 sentence 1 (c) GDPR insofar as processing is necessary for compliance with legal obligations
  • pursuant to Art. 6 para. 1 sentence 1 (f) GDPR insofar as processing is necessary to safeguard the legitimate interests of BATO or a third party. The legitimate interests of BATO are the functionality of the IT system and the marketing of products and services provided by BATO in particular.

Storage location and duration of storage, automatic deletion

We store your personal data on servers in the territory of the Federal Republic of Germany.

Your personal data will be stored by us only until the purpose for which it was collected has been fulfilled. The personal data will then be automatically deleted insofar as no further processing is required for other reasons and is legally permissible.

The personal data collected during visits to our website are saved insofar as it is necessary to identify you as a user. The personal data will subsequently be deleted automatically. The personal data stored for the fulfilment of contracts will be deleted when the respective contractual relationship has ended, all claims have been met and there are no other legal obligations to store data or justifications for further processing of the data, such as obligations to retain data from the German Commercial Code or the German Tax Code.
